How to create a freelance contract

Quick answer: To create a freelance contract, name both sides, describe the project, set the money, choose the protections and download and sign.

  1. Name both sides. Your name or business and the client's, with addresses.
  2. Describe the project. What you'll do and the exact deliverables. The clearer this is, the fewer arguments later.
  3. Set the money. Fixed price with a deposit, an hourly rate, or milestones, plus when invoices are due.
  4. Choose the protections. Revision rounds, when ownership passes to the client, confidentiality, and what happens if the project is cancelled.
  5. Download and sign. Send the PDF to the client and both sign it before the work starts.

The clauses that protect freelancers

A deposit before you start, a limit on revisions, ownership passing only after full payment, a late-payment fee, and a kill fee if the client cancels halfway. These cover the most common disputes.

Not legal advice

This is a clear starting template. Laws differ between countries and states, so for large or unusual projects, have a lawyer review it.

Frequently asked questions

Do I need a contract for small jobs?

Even a one-page agreement avoids most problems: it sets the price, the deadline and what's included.

What is a kill fee?

A payment the client owes if they cancel after work has started, often 25–50% of the remaining fee, to cover your booked time.
